einer <a href=\"http:\/\/imslpforums.org\/Second%20U-E%20Cease%20and%20Desist%20Letter.pdf\">Unterlassungsaufforderung<\/a> geeignete Gegenmassnahmen verlangte.&nbsp;Das IMSLP sammelte Scans von Musiknoten, deren Copyright abgelaufen ist, und nutzte dazu die MediaWiki-Software, auf der auch die Wikipedia aufbaut.<\/p>\n<p>Wie der Initiator des Projekts Xiao-Guang Guo schreibt, habe Universal Edition zwar nicht die Schliessung des Wikis verlangt; die Umsetzung der geforderten Massnahmen w\u00fcrden aber seine M\u00f6glichkeiten \u00fcbersteigen. Und auf einen Rechtsstreit wollte sich der Student verst\u00e4ndlicherweise nicht einlassen. Er bietet aber Hand dazu, dass eine Organisation das Projekt weiterf\u00fchrt:<\/p>\n<blockquote>\n<p>&#171;Due to demand, I strongly encourage any organization willing to support a continuation of IMSLP to contact me at <a href=\"mailto:imslp@imslp.org\">imslp@imslp.org<\/a>.&#187;<\/p>\n<\/blockquote>\n<p>Letzteres w\u00e4re aus meiner Sicht ausgesprochen w\u00fcnschenswert. Es geht mir nicht einmal so sehr um den Fortbestand des IMSLP, sondern um die Kl\u00e4rung der Grundsatzfrage, wie weit der Betreiber eines Wikis f\u00fcr Copyright-Verletzungen haftbar gemacht werden kann. Denn letztlich (und das m\u00fcsste auch Ken Clark als Anwalt von Universal Edition wissen) ist es unm\u00f6glich, Copyright-Verletzungen in einem Wiki 100prozentig auszuschliessen, wenn man nicht jeden Beitrag vor der Ver\u00f6ffentlichung einem Rechtsgutachten unterziehen will (was sicher nicht praktikabel ist und dem Wiki-Prinzip fundamental widerspricht). Auch der vom Anwalt konkret vorgeschlagene IP-Filter w\u00e4re ein v\u00f6llig untaugliches Mittel:<\/p>\n<blockquote>\n<p>&#171;It is our understanding that it is possible to filter lP addresses of those who take part in copying files from your site to prevent such unauthorized copyright infringement.&#187;<\/p>\n<\/blockquote>\n<p>Sollte der Fall&nbsp;der IMSLP Schule machen,&nbsp;dann m\u00fcssten wohl viele&nbsp;Wikis auf dieser Welt offline gehen. Ein Musterprozess, der die Grenzen der Haftbarkeit von Wiki-Betreibern auslotet, w\u00e4re deshalb w\u00fcnschenswert. Pers\u00f6nlich scheint es mir fragw\u00fcrdig, den Plattformbetreiber haftbar zu machen, weil er einfacher greifbar ist als der eigentliche Copyright-Verletzer.
